What is data transparency?
It is aimed at building trust by telling you why we collect your personal information, how we use it, and who has access to it. Therefore, we provide a Data Privacy Notice at each stage of collecting your data, which you are required to read and provide consent before sharing your personal information with us.
What guides how the firm handles data?
The Data Protection Act, 2020 (DPA) and the Data Protection Regulations, 2024 guide how we handle your data. Furthermore, our firm has the added benefit of having its founder, Mrs. Alia Vaz-Heaven, as a trained Data Protection Officer (DPO). Although she will not function as the DPO for the firm, she has knowledge of the data protection standards pursuant to the DPA and the relevant provisions and principles under the EU's General Data Protection Regulation, 2018.
What are the data protection standards under the DPA?
Pursuant to Part IV of the DPA, there are eight (8) standards for processing personal data as follows:

Accuracy (Section 27)
Storage Limitation (Section 28)

How am I assured that my data is processed fairly and lawfully?
In keeping with our guiding principles of transparency, reliability, and integrity, we will never mislead you as to how your data is handled. Therefore, the Data Privacy Notice, which governs how we handle your personal data, is provided on each form that you are required to complete and in each Retainer Agreement, with a link to access the full Data Privacy Policy on our website.
What types of data do you collect?
As part of our legal obligation to know our clients, and in compliance with the government's regulatory framework, we will collect both general and sensitive personal data such as, but not limited to the following:
Full name, home and email addresses, and telephone numbers
Biometric data such as photograph and signature
Taxpayer Registration Number (TRN), passport and driver's licence numbers
Financial information including bank account details, source of funds, and source of wealth
Politically exposed information
Physical and mental health information
Criminal history
Employment history
Will you share any of my personal data?
Yes, but only what is required to comply to the government's regulatory frameworks such as those governing proceeds of crime and money laundering. Therefore, in order to open your unique client account with JMMB, all the information captured on the Know Your Client Form along with your TRN and a national photo identification must be shared with them.
Furthermore, if representing you in any legal proceedings, any necessary personal data must be shared with the court for the administration of justice.
How do you store my data?
All client paper files are stored in locked cabinets and under the Attorney's control. In addition, all electronic personal data are stored securely on the cloud because we use business-tier cloud environments (paid subsciptions) powered by Google Workspace and Microsoft 365 to protect client data.
For how long will you keep my files?
Pursuant to Section 28 of the DPA, we will not keep your personal data for longer than is necessary for the purpose for which it was collected.
